Terms of Use
These terms are an agreement between you and Kawi Software AS (organisation number 933 580 873, Fredrik Meltzers gate 13 B, 5007 Bergen, Norway; "we", "us"). They apply when you use the AdCreator+ app and the website tryadcreator.com (together, "AdCreator+"). By creating an account, buying a plan or otherwise using AdCreator+, you agree to these terms. Our Privacy Policy explains how we handle personal data.
If you use AdCreator+ for a business, you accept these terms on behalf of that business, and "you" also means the business. Some rules are different for consumers (people using AdCreator+ outside their trade or business) and business users. Where this matters, the terms say so. Nothing in these terms limits rights you have as a consumer under mandatory law.
1. What AdCreator+ is
AdCreator+ helps you make image and video ads. You give it a website, photos or a short description. It builds a brand profile and suggests ad concepts, and AI models create images, videos, AI spokesperson videos, copy, voice-overs and music. You can edit, resize and export the results, and save or share them.
AI models from third parties (currently Google) do much of this work. Results depend on those models and can vary. We keep improving AdCreator+, so features, templates, formats and models may change, and new features may be marked as beta. We do not promise that AdCreator+ is always available or free of errors.
2. Your account
- Age. You must be at least 16 years old to use AdCreator+. If you are under 18, you need permission from a parent or guardian, who accepts these terms for you and is responsible for any purchases.
- Guest and signed-in accounts. The app starts with a guest account. Sign in with Apple, Google or email to keep your work if you change or lose your device. If you delete the app or sign out of a guest account before you sign in, you may lose access to your work.
- Keep it safe. You are responsible for what happens in your account and for keeping your sign-in secure. Tell us at once if you think someone else has used it.
- One person per account. Do not share your account or create several accounts to get more free credits or rewards.
3. Your content
You keep your rights. Your photos, logos, brand material, texts and instructions ("your content") stay yours.
You must have the rights. Only upload or import content you own or have permission to use. In particular:
- only import a website, logo or brand that belongs to you or that you are authorised to promote;
- only upload photos of people if you have their permission to use them in advertising;
- when you use "Remix" with a reference ad, AdCreator+ borrows its layout and idea, not its brand, text or people. Do not use it to copy another company's ad, trademarks or protected material.
Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt and show your content, but only to provide, secure and improve AdCreator+ for you: for example, to send it to our AI providers, render your ads, store your work and support you. This licence ends when you delete the content or your account, except for copies we must keep by law or that are in backups for a short time (see the Privacy Policy). We do not use your content to train AI models, and we do not use your content or ads in our own marketing without your permission.
Sharing. If you create a share link, anyone with the link can view that ad until you delete your account. If you publish a template to the community, you also give other AdCreator+ users a licence to view it and use it in their own ads, for as long as it is published. You can unpublish it at any time; ads that others already made with it are not affected.
4. Plans, payments and credits
4.1 Free use
You can try AdCreator+ for free. Free use includes a small number of images, which carry an AdCreator+ watermark and have a lower resolution. Video and some other features need a paid plan. To protect free credits from misuse, we may only give them on devices that pass our app integrity check. We may change what the free plan includes.
4.2 Subscriptions
- Bought through the store. Subscriptions and credit packs are sold in the app through Apple's App Store or Google Play, and paid with the payment method in your Apple or Google account. The price, the billing period and what is included are shown before you buy. Apple's or Google's terms also apply to the purchase.
- Automatic renewal. A subscription renews automatically at the end of each period (weekly, monthly or yearly) at the then-current price, unless you turn off auto-renew at least 24 hours before the period ends. Your account is charged within the 24 hours before the new period starts.
- Cancelling. Cancel in your Apple ID subscription settings (App Store) or in Google Play › Payments & subscriptions. Deleting the app or your AdCreator+ account does not cancel a subscription. After you cancel, your plan stays active until the end of the period you have paid for.
- Free trials. If a plan includes a free trial, you are charged when the trial ends unless you cancel at least 24 hours before. If you buy a subscription during a trial, the rest of the trial ends.
- Price changes. Apple and Google tell you about price changes for subscriptions and ask for your consent when their rules or the law require it.
4.3 Credits
- What credits are. Paid features are measured in credits. The app shows how many credits a job costs before you start it. If a job fails, its credits are returned automatically.
- Allowance per period. A subscription gives you a credit allowance for each period: every week or month on weekly and monthly plans, and every month on yearly plans (even though you pay once a year).
- Carry-over limit. Unused credits carry over, but a refill only tops your balance up to a limit, normally twice the allowance for one period. If your balance is already at or above that limit, the refill adds fewer credits or none. A refill never takes credits away.
- Credit packs. Credits you buy in a pack are added to your balance in full. They count towards the carry-over limit when a subscription refill is added.
- Earlier subscriptions. Weekly and monthly subscriptions that started before AdCreator+ 5.0 keep their earlier credit level for as long as they renew without a break. Yearly plans now get their credits as a monthly refill.
- No cash value. Credits are a right to use AdCreator+ features. They are not money or electronic money, have no cash value, cannot be exchanged for money, and cannot be sold or transferred to another account. Credits in your balance stay there when a subscription ends, but some features need an active plan. Credits are lost if you delete your account.
- Changes. We may change the credit cost of features for jobs you start in the future, but never for a job you have already started. If a purchase is refunded or reversed, we may remove the credits it gave you.
4.4 Refunds and the right of withdrawal
Purchases are processed by Apple or Google, and refunds go through them under their policies: for Apple, at reportaproblem.apple.com; for Google Play, through the Play Store's refund options. We cannot refund store purchases directly. If you live in the EEA or the UK, you may have a statutory right to withdraw from an online purchase within 14 days. For purchases in the App Store or Google Play, the store handles this under its terms. This section does not limit your rights under mandatory consumer law, including your rights if AdCreator+ does not work as promised.
4.5 Invite program
When we run an invite program, the rules shown in the app apply. In short: rewards are credits with no cash value; you only get a reward when the friend you invite starts a paid plan, never just for an install or sign-up; there may be a monthly limit; and you may not invite yourself or misuse the program. If we find misuse, we may cancel the rewards. We may change or end the program at any time; credits already earned stay on your account.
5. AI-generated ads
Who owns the output. Between you and us, you own the ads you create with AdCreator+. To the extent we have any rights in them, we transfer those rights to you. Our templates, layouts, fonts, music and other material we provide stay ours or our licensors'. You may use them as part of your ads, but not on their own (for example, you may not sell a template or a music track separately). In some countries, AI-generated material may not be protected by copyright, and the AI may create similar results for other users.
Check before you publish. AI can make mistakes. It can misspell words, get facts or prices wrong, show products inaccurately, or produce something that looks like someone else's brand or work. You are responsible for reviewing every ad before you use it, and for the ads you publish. In particular:
- Claims. Every claim in your ad (prices, discounts, results, health or environmental claims, comparisons, reviews and ratings) must be true, and you must be able to prove it.
- Laws and platform rules. Your ads must follow the law where they are shown (for example marketing, consumer, copyright and trademark law) and the advertising policies of the platforms you use, such as Meta, Google, TikTok or Snapchat. Ad platforms decide for themselves whether to approve your ads.
- AI labelling. Where the law or a platform requires it, say that an ad was made or changed with AI, and use the platform's AI label. AI spokesperson videos carry an "AI-generated" label by default. Only turn it off where no law or platform rule requires it.
- Watermark. Do not remove or hide the AdCreator+ watermark on ads made on the free plan.
AI presenters. Presenters in AI spokesperson videos are invented people, not real people. Do not present an AI presenter as a real customer, employee or expert. Do not use one for testimonials, reviews or endorsements that did not happen, and do not try to make one look or sound like a real person.
No performance promise. We do not promise that an ad will perform well, be approved by an ad platform, or be unique.
6. Our rights
AdCreator+ and everything we provide in it (the app, website, software, templates, formats, designs, fonts and music we license, and the AdCreator+ name and logo) belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app and website according to these terms. You may not copy, sell or redistribute the app, or reverse-engineer it, except where the law allows this. If you send us feedback or ideas, we may use them without obligation to you.
7. Acceptable use
Do not use AdCreator+ to create, upload or publish content that:
- is illegal, or promotes illegal products or services;
- is misleading or deceptive, such as false claims, fake reviews or testimonials, fake scarcity or fake endorsements;
- impersonates a real person, brand or organisation, or shows a real person (including public figures) without their permission;
- is about elections, referendums, political campaigns or social issues, unless the ad follows the authorisation and disclosure rules of the law and of every platform where it runs. AI presenters may never be used in such content;
- is sexually explicit, or sexualises or exploits minors in any way;
- is hateful, harassing, violent or threatening, or promotes self-harm;
- infringes copyrights, trademarks or other rights, or shares other people's private information;
- advertises weapons, drugs, tobacco or vaping products, gambling, or other regulated goods or services without complying with every law and platform rule that applies;
- is spam, malware or phishing.
Content made with Google's AI models must also follow Google's Generative AI Prohibited Use Policy.
Do not misuse AdCreator+ itself. For example, do not:
- get around credits, limits, watermarks, app integrity checks or other protections;
- create several accounts to get free credits or rewards;
- scrape, overload or attack the service, or access it with bots or tools other than our app and website;
- resell access to AdCreator+;
- use AdCreator+ or its output to build or train AI models that compete with AdCreator+ or our AI providers.
Our systems may automatically refuse requests that seem to break these rules. If you think a refusal was wrong, contact us.
8. Other companies' services
AdCreator+ relies on services from Apple, Google, RevenueCat and others, and lets you share ads to other apps and platforms. Their terms apply when you use them, and we are not responsible for their services. AdCreator+ is not affiliated with or endorsed by Meta, Google, TikTok or any other ad platform.
9. Ending your use
You can stop using AdCreator+ at any time and delete your account in the app (Account › Delete account). Deleting your account permanently removes your work and your credits. Remember to cancel any subscription in the store.
We may suspend or close your account, or remove content, if you seriously or repeatedly break these terms, misuse free credits or the invite program, put others or the service at risk, or if the law requires it. Unless the law or safety prevents it, we will tell you why and, where reasonable, give you a chance to fix the problem and download your ads first.
If we decide to close AdCreator+ altogether, we will give at least 30 days' notice in the app, stop new renewals, and refund prepaid periods you cannot use where the law requires it.
10. Warranties and disclaimers
We provide AdCreator+ with reasonable care and skill. For business users, AdCreator+ is otherwise provided "as is" and "as available", without warranties of any kind, to the extent the law allows. For consumers, you keep all your rights under mandatory consumer law (in Norway, for example, the rules on digital services in digitalytelsesloven). If AdCreator+ does not work as agreed, you can contact us and we will try to fix it.
11. Limitation of liability
Nothing in these terms limits liability for death or personal injury, for damage caused intentionally or by gross negligence, or any other liability that cannot be limited by law.
For consumers, we are liable under the law of your country.
For business users, and as far as the law allows:
- we are not liable for indirect or consequential loss, such as lost profit, lost revenue, wasted ad spend, loss of data or harm to reputation;
- our total liability under these terms is limited to the amount you paid for AdCreator+ in the 12 months before the event that caused the claim.
We are not responsible for how you use your ads, or for decisions made by ad platforms, app stores or other third parties.
12. Indemnity (business users)
If you are a business user, you will compensate us for reasonable costs and losses, including legal fees, if a third party makes a claim against us because of content you uploaded, ads you published, or your breach of these terms.
13. Changes to these terms
We may update these terms, for example when we add features or when the law changes. If a change is significant, we will tell you in the app or by email at least 30 days before it takes effect. A change never applies to a subscription period you have already paid for. If you do not agree to a change, you can stop using AdCreator+ and cancel your subscription before the change takes effect.
14. Law and disputes
These terms are governed by Norwegian law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.
Please contact us first so we can try to solve the problem. Consumers in Norway can also ask Forbrukerrådet to mediate, and take the case to Forbrukerklageutvalget. Disputes that are not solved go to the Norwegian courts. Business users agree that the court for our registered office is the court of first instance. Consumers can bring a case where they live, as the law allows.
15. Additional terms for Apple devices
If you downloaded AdCreator+ from Apple's App Store, the following also applies:
- These terms are between you and Kawi Software AS, not Apple. Kawi Software AS, not Apple, is responsible for AdCreator+ and its content.
- Your licence to the app is limited to using it on Apple-branded products that you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app does not conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any). To the extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for handling any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
